Section 377 of Indian Penal Code
Section 377 or article 377 of IPC has been in much of the debate for quite some time. Today Delhi High Court had devriminalized homosexuality in a historic judgement. They gave this decision by reading down section 377 of the Indian Penal Code.
Section 377, a law has been there from the British Raj era. It says that homosexuality and “unnatural sex” is a criminal act.
Bench of Chief Justice Ajit Prakash Shah and Justice S Muralidhar said that if not amended, section 377 of the IPC would violate Article 21 of the Indian constitution, which states that every citizen has equal opportunity of life and is equal before law.

Culture changes with time . No one can stop a culture from changing. It evolves and strengthens with time. Homosexuality is not against any culture. It is our short comings ,selfishness and hypocrisy because of which we dont look beyond our own needs and orientation. Science has proved that homosexuality is not a preference but an orientation. Homosexuality exists in animals too. Who decides what’s natural and unnatural? When what we do has been named as natural by us , we do not have any right to call what others do different as unnatural. Homosexuality is as old as the existance of man. No one can suppress the truth. It can only be delayed by resistance and non-acceptance. We need to look around and help others to be their true selves. In India most homosexuals live a dual life. They marry and have kids and live a life of lie till they die. We have such people in our family and our neighborhood. We should look beyond ourselves and help others lead a life of truth. Be a human in the true sense of the word.
So far I was afraid of safe return of my daughter at the end of the day. Hereafter I should be equally afraid of my son’s!
When hundreds of farmers are committing sucides, billions of people are famishing under poverty line, so may issues are crying our attention should we need to urgently convene inter-ministerial meeting to sort this issue first?
When lakhs of cases are awating decision in the courts, when so many lives of undertrials are at stake in the courts, do we need this judgement urgently on this so called public interest pettion (or is it a penile interest petition?)?
Will the economy come out of recession if Sec. 377 of IPC is amended/repealed?
When we liberalise our economy have we signed in the WTO to liberalise these provisions?
Please think over…..
Section 377 says “Unnatural Offences: Whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with imprisonment for life, or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.”
How blind we are? if now we allow gay sex to be allowed, sooner or later, we will have to allow animal sex and incest (sex within family members) to happen also as it happens in western countries!! Do you want that to happen?? Being open to growth and being human in attitude doesnt mean that we degrade the gift of sex within us……these decisions we take now can have long term effects in future….prepare urself to face it…..either then or now…
we all complain about ours laws being the same over the time and never having to change them with the change in society. today when this phenomenal change has taken place, we are all frowning over the same..why?? because we were not yet ready for the blow!! i wonder why was it criminalized anyway?? may be then, it was seen as an offense…but why now? these people, the homosexuals, are not homos by choice, they are so by birth….which is a natural trait…then why call it an un-natural offense…? and of coz when forceful intercourse between a man and a woman is also illegal, so will this be…why stop them legally jus coz we dint wanna amend our age-old, outdated laws!! society is ever – evolving, and laws will have to be adjusted accordingly…we have to accept this … sooner the better…
